According to the statement from the trade association, China contests the tariffs implemented from April 5: 10% for all trading partners and 34% specifically on Chinese products (effective April 9).
China contends that the actions are not aligned with US commitments under several clauses of the 1994 General Agreement on Tariffs and Trade, the Customs Valuation Agreement, and the Agreement on Subsidies and Countervailing Measures.
The conflict will be addressed by the WTO's dispute resolution body in a bilateral dialogue format. If the discussions do not result in a settlement of the disagreement after 60 days, the claimant may ask for a panel decision. As of 2019, the appellate body of the organization has remained inactive because the U.S. has prevented new judicial appointments. Moreover, the WTO lacks the authority to enforce a decision.
