In June 2020, a class action lawsuit was launched against Google. Attorneys for the plaintiffs and the company declared at the end of December 2023 that they had come to a settlement to assist with the lawsuit's settlement. Among other things, the plaintiffs claimed that Google kept track of individuals' online activities even while they were using incognito mode.

Thanks to the efforts of Google's lawyers, a trial to address the merits of the action was postponed until August 2023, when Judge Yvonne Gonzalez Rogers denied the corporation's move to dismiss the case. As a result, the parties began negotiating.

In accordance with the terms of the settlement agreement, Google will have to be clearer about the level of privacy that users can access when using incognito mode in addition to removing billions of records from data centers. The agreement also includes other restrictions intended to restrict the company's acquisition of personal data. At that, the claimants will not be compensated.
